EM 09\/12\/2008"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>ESTADO DO ESP\u00cdRITO SANTO<\/strong><b><\/b><\/p>\n<p style=\"text-align: center;\"><strong>PODER JUDICI\u00c1RIO<\/strong><b><\/b><\/p>\n<p style=\"text-align: center;\"><strong>TRIBUNAL DE JUSTI\u00c7A<\/strong><b><\/b><\/p>\n<p style=\"text-align: center;\"><strong>GABINETE DA PRESID\u00caNCIA<\/strong><b><\/b><\/p>\n<p style=\"text-align: center;\"><strong>RESOLU\u00c7\u00c3O N\u00ba 29\/2008<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>EMENTA<\/strong> \u2013 Regulamenta a atua\u00e7\u00e3o dos Ju\u00edzes de Paz perante as Varas de Fam\u00edlia.<\/p>\n<p style=\"text-align: justify;\">O Excelent\u00edssimo Senhor Desembargador FREDERICO GUILHERME PIMENTEL, Presidente do Egr\u00e9gio Tribunal de Justi\u00e7a do Estado do Esp\u00edrito Santo, no uso de suas atribui\u00e7\u00f5es legais, e tendo em vista decis\u00e3o do Egr\u00e9gio Tribunal Pleno, e<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> os termos da Recomenda\u00e7\u00e3o n\u00ba 16 do Conselho Nacional de Justi\u00e7a, de 27 de maio de 2008, que recomenda aos Tribunais de Justi\u00e7a a regulamenta\u00e7\u00e3o da fun\u00e7\u00e3o de Juiz de Paz prevista no art. 98, II, da Constitui\u00e7\u00e3o Federal;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> o disposto no art. 1\u00ba, par\u00e1grafo \u00fanico, al\u00ednea c, da Lei Estadual n\u00ba 4.380\/90, alterada pela Lei Estadual n\u00ba 5.871\/99;<\/p>\n<p style=\"text-align: justify;\"><strong>RESOLVE:<\/strong><b><\/b><\/p>\n<p style=\"text-align: justify;\"><strong>Art. 1\u00ba<\/strong>. Dentre as atribui\u00e7\u00f5es preconizadas no art. 1\u00ba, da Lei 4.380\/90, alterada pela Lei n\u00ba 5.871\/99, compreende-se a fun\u00e7\u00e3o conciliat\u00f3ria do Juiz de Paz, inclusive em Vara de Fam\u00edlia, sempre a crit\u00e9rio do Juiz de Direito.<\/p>\n<p style=\"text-align: justify;\"><strong>Art. 2\u00ba<\/strong>.
