{"id":18769,"date":"2017-09-19T14:34:01","date_gmt":"2017-09-19T17:34:01","guid":{"rendered":"https:\/\/www.tjes.jus.br\/corregedoria\/?p=18769"},"modified":"2017-09-19T14:34:01","modified_gmt":"2017-09-19T17:34:01","slug":"oficio-circular-no-2022005-publ-29122005","status":"publish","type":"post","link":"https:\/\/www.tjes.jus.br\/corregedoria\/2017\/09\/19\/oficio-circular-no-2022005-publ-29122005\/","title":{"rendered":"OF\u00cdCIO CIRCULAR N\u00ba 202\/2005 &#8211; PUBL. 29\/12\/2005"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>ESTADO DO ESP\u00cdRITO SANTO<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>PODER JUDICI\u00c1RIO<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>CORREGEDORIA GERAL DA JUSTI\u00c7A<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Vit\u00f3ria (ES), 30 de novembro de 2005.<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>OF\u00cdCIO CIRCULAR N.\u00ba 202\/2005<\/strong><\/p>\n<p style=\"text-align: justify;\">Senhor(a) Juiz(a),<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> que a Corregedoria Geral da Justi\u00e7a do Estado do Esp\u00edrito Santo \u00e9 \u00f3rg\u00e3o de fiscaliza\u00e7\u00e3o, disciplina e orienta\u00e7\u00e3o administrativa, com jurisdi\u00e7\u00e3o em todo o Estado, conforme artigo 2\u00ba da Lei Complementar Estadual 83\/96;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong>, n\u00e3o s\u00f3 o disposto no art. 69, II, da Lei Complementar n.\u00ba 234\/02, mas tamb\u00e9m o art. 148, III e o par\u00e1grafo \u00fanico, al\u00ednea \u201cb\u201d, da Lei n.\u00ba 8.069\/90.<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> o precedente firmado pela Jurisprud\u00eancia, no que diz respeito a destitui\u00e7\u00e3o do poder familiar para ado\u00e7\u00e3o.<\/p>\n<p style=\"text-align: justify;\"><strong>RECOMENDO<\/strong> aos Magistrados deste Estado que na hip\u00f3tese de pedido de destitui\u00e7\u00e3o de poder familiar, visando uma futura ado\u00e7\u00e3o, independentemente de estarem configurados nos casos previstos no art. 98 do <strong>ECA<\/strong>, seja atribu\u00edda ao Juiz da Vara Especializada em mat\u00e9ria de Inf\u00e2ncia e Juventude a compet\u00eancia para aqueles pedidos.<\/p>\n<p style=\"text-align: justify;\">Atenciosamente,<\/p>\n<p style=\"text-align: center;\"><strong>DES.
