{"id":20314,"date":"2017-10-18T14:46:28","date_gmt":"2017-10-18T16:46:28","guid":{"rendered":"https:\/\/www.tjes.jus.br\/corregedoria\/?p=20314"},"modified":"2017-10-18T14:46:28","modified_gmt":"2017-10-18T16:46:28","slug":"oficio-circular-cgjes-no-302012-publ-03042012","status":"publish","type":"post","link":"https:\/\/www.tjes.jus.br\/corregedoria\/2017\/10\/18\/oficio-circular-cgjes-no-302012-publ-03042012\/","title":{"rendered":"OF\u00cdCIO-CIRCULAR CGJES N\u00ba 30\/2012 &#8211; PUBL. 03\/04\/2012"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>ESTADO DO ESP\u00cdRITO SANTO<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>PODER JUDICI\u00c1RIO<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>CORREGEDORIA GERAL DA JUSTI\u00c7A<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>OF\u00cdCIO-CIRCULAR CGJES n\u00ba 30\/2012.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Ref.: Protocolo n\u00ba 1202347<\/strong><\/p>\n<p style=\"text-align: justify;\">Vit\u00f3ria\/ES, 30 de mar\u00e7o de 2012.<\/p>\n<p style=\"text-align: justify;\"><strong>Senhores Ju\u00edzes de Direito Diretores do Foro e Ju\u00edzes de Direito com Jurisdi\u00e7\u00e3o em Registro P\u00fablico e Senhores Delegat\u00e1rios Titulares e Interinos do Foro Extrajudicial,<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> que a Corregedoria Geral da Justi\u00e7a \u00e9 \u00f3rg\u00e3o de fiscaliza\u00e7\u00e3o, disciplina e orienta\u00e7\u00e3o administrativa, com jurisdi\u00e7\u00e3o em todo o Estado, conforme art. 35 da Lei Complementar Estadual n\u00ba 234\/02;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> os termos do Of\u00edcio-Circular n\u00ba 029\/CNJ\/COR\/2012, da lavra da Ministra Eliana Camon, Corregedora Nacional de Justi\u00e7a;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> a RECOMENDA\u00c7\u00c3O n\u00ba 03, editada pela Corregedoria Nacional de Justi\u00e7a, que disp\u00f5e sobre a cientifica\u00e7\u00e3o pr\u00e9via das partes envolvidas nos atos notariais especificados, da possibilidade de obten\u00e7\u00e3o da Certid\u00e3o Negativa de D\u00e9bitos Trabalhistas (CNDT), prevista no artigo 642-A do CLT;<\/p>\n<p style=\"text-align: justify;\"><strong>RESOLVE<\/strong>:<\/p>\n<p style=\"text-align: justify;\"><strong>Art. 1\u00ba <\/strong>&#8211; <strong>RECOMENDAR<\/strong> aos delegat\u00e1rios dos servi\u00e7os notariais que cientifiquem as partes envolvidas da possibilidade de obten\u00e7\u00e3o pr\u00e9via de Certid\u00e3o Negativa de D\u00e9bitos Trabalhistas &#8211; CNDT, nos termos do art. 462-A da CLT, nas hip\u00f3teses de aliena\u00e7\u00e3o ou onera\u00e7\u00e3o, a qualquer t\u00edtulo, de bem im\u00f3vel ou direito a ele relativo e de partilha de bens im\u00f3veis em raz\u00e3o de separa\u00e7\u00e3o, div\u00f3rcio ou dissolu\u00e7\u00e3o de uni\u00e3o est\u00e1vel.<\/p>\n<p style=\"text-align: justify;\"><strong>Art. 2\u00ba <\/strong>&#8211; <strong>DETERMINAR<\/strong> aos delegat\u00e1rios dos servi\u00e7os notariais que fa\u00e7am constar da escritura lavrada que a cientifica\u00e7\u00e3o referida no artigo anterior foi previamente realizada.<\/p>\n<p style=\"text-align: justify;\"><strong>Art. 3\u00ba <\/strong>&#8211; <strong>DETERMINAR<\/strong> aos magistrados com jurisdi\u00e7\u00e3o em Registro P\u00fablico que fiscalizem o efetivo cumprimento da determina\u00e7\u00e3o contida na RECOMENDA\u00c7\u00c3O n\u00ba 03, da Corregedoria Nacional de Justi\u00e7a.<\/p>\n<p style=\"text-align: justify;\"><strong>Publique-se.
