{"id":20738,"date":"2017-11-01T16:41:18","date_gmt":"2017-11-01T18:41:18","guid":{"rendered":"https:\/\/www.tjes.jus.br\/corregedoria\/?p=20738"},"modified":"2017-11-01T16:46:09","modified_gmt":"2017-11-01T18:46:09","slug":"provimento-no-302005-publ-12082005","status":"publish","type":"post","link":"https:\/\/www.tjes.jus.br\/corregedoria\/2017\/11\/01\/provimento-no-302005-publ-12082005\/","title":{"rendered":"PROVIMENTO N\u00ba 30\/2005 &#8211; PUBL. 12\/08\/2005"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>ESTADO DO ESP\u00cdRITO SANTO<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>CORREGEDORIA GERAL DA JUSTI\u00c7A<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>PROVIMENTO N\u00ba 030\/05<\/strong><\/p>\n<p style=\"text-align: justify;\">O EXCELENT\u00cdSSIMO SENHOR CORREGEDOR-GERAL DA JUSTI\u00c7A DO ESTADO DO ESP\u00cdRITO SANTO, DESEMBARGADOR FREDERICO GUILHERME PIMENTEL, NO USO DE SUAS ATRIBUI\u00c7\u00d5ES LEGAIS E,<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> que a Corregedoria Geral da Justi\u00e7a do Estado do Esp\u00edrito Santo \u00e9 \u00f3rg\u00e3o de fiscaliza\u00e7\u00e3o, disciplina e orienta\u00e7\u00e3o administrativa, com jurisdi\u00e7\u00e3o em todo o Estado, conforme artigo 2\u00ba da Lei Complementar Estadual 83\/96;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> as reiteradas d\u00favidas e diversas orienta\u00e7\u00f5es dadas atrav\u00e9s de of\u00edcios-circulares quando a cobran\u00e7a do dep\u00f3sito pr\u00e9vio da nota 3 da tabela 6 da Lei 4.847\/93 com nova reda\u00e7\u00e3o dada pela Lei 6.670\/2001.<\/p>\n<p style=\"text-align: justify;\"><strong>RESOLVE<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Art. 1\u00ba <\/strong>&#8211; O art. 3\u00ba do <a href=\"https:\/\/www.tjes.jus.br\/corregedoria\/2016\/10\/13\/provimento-no-252005-disp-13052005\/\" target=\"_blank\" rel=\"noopener\">Provimento N\u00ba 025\/05<\/a>, passa vigorar com a seguinte reda\u00e7\u00e3o:<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">&#8220;Art. 3\u00ba Nos processos em que a dilig\u00eancia INICIAL relativa \u00e0 cita\u00e7\u00e3o, notifica\u00e7\u00e3o ou intima\u00e7\u00e3o for realizada pelos Correios, mas n\u00e3o lograr \u00eaxito, dever\u00e1 o Escriv\u00e3o intimar o requerente, preferencialmente atrav\u00e9s de seu procurador \u2013 via Di\u00e1rio da Justi\u00e7a \u2013 a fim de providenciar o recolhimento da despesa prevista na Nota 03, da Tabela 06, indicando o respectivo valor a ser depositado, bem como a conta banc\u00e1ria utilizada para tal finalidade.<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">Par\u00e1grafo \u00fanico . O valor recolhido a tal t\u00edtulo caber\u00e1 UMA \u00daNICA VEZ, ao Oficial de Justi\u00e7a.&#8221;<\/p>\n<p style=\"text-align: justify;\"><strong>Art. 2\u00ba<\/strong>&#8211; Este provimento entra em vigor na data da publica\u00e7\u00e3o.<\/p>\n<p style=\"text-align: justify;\"><strong>REGISTRE-SE.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>PUBLIQUE-SE<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><strong>CUMPRA-SE<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Vit\u00f3ria, 09 de agosto de 2005.<\/p>\n<p style=\"text-align: center;\"><strong>DES.
