O Excelent\u00edssimo Desembargador<strong>\u00a0FABIO CLEM DE OLIVEIRA,<\/strong>\u00a0DD. Presidente do Egr\u00e9gio Tribunal de Justi\u00e7a do Estado do Esp\u00edrito Santo, no uso de suas atribui\u00e7\u00f5es legais e,<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">CONSIDERANDO as regras previstas na Lei Federal n\u00ba 11.788, de 25 de setembro de 2008, que disp\u00f5e sobre o est\u00e1gio de estudantes;<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">CONSIDERANDO os termos do artigo 43 da Resolu\u00e7\u00e3o TJES n\u00ba 07\/2016, que regulamenta o Programa de Est\u00e1gio Remunerado no \u00e2mbito do Poder Judici\u00e1rio do Estado do Esp\u00edrito Santo, o qual disp\u00f5e acerca do gozo do recesso remunerado pelos estagi\u00e1rios, e em especial os \u00a7\u00a7 3\u00ba e 4\u00ba, os quais prescrevem que \u201c<em>Em nenhuma hip\u00f3tese, o est\u00e1gio poder\u00e1 ser realizado em per\u00edodo superior a 11 (onze) meses sem o correspondente gozo dos 30 (trinta) dias de descanso remunerado\u201d e que \u201cO gozo do recesso remunerado deve ocorrer dentro do prazo de vig\u00eancia do contrato de est\u00e1gio<\/em>\u201d;<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">CONSIDERANDO a institui\u00e7\u00e3o do Sistema de Escritura\u00e7\u00e3o Digital das Obriga\u00e7\u00f5es Fiscais, Previdenci\u00e1rias e Trabalhistas (eSocial) pelo Decreto Federal n\u00ba 8.373, de 11 de dezembro de 2014, por meio do qual os \u00f3rg\u00e3os p\u00fablicos dever\u00e3o prestar informa\u00e7\u00f5es trabalhistas, previdenci\u00e1rias e fiscais em rela\u00e7\u00e3o aos seus trabalhadores;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">RESOLVE:<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">Art. 1\u00ba. O estagi\u00e1rio tem direito ao gozo de 30 (trinta) dias de recesso remunerado, sempre que o est\u00e1gio tenha dura\u00e7\u00e3o igual ou superior a 01 (um) ano, a ser gozado preferencialmente durante suas f\u00e9rias escolares, sem preju\u00edzo do pagamento da bolsa de complementa\u00e7\u00e3o educacional.<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">\u00a71\u00ba. O usufruto do recesso deve ocorrer dentro do per\u00edodo da vig\u00eancia do termo de compromisso de est\u00e1gio ou de cada um de seus aditivos, sendo vedada a op\u00e7\u00e3o pela indeniza\u00e7\u00e3o em detrimento da frui\u00e7\u00e3o do descanso remunerado.<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">\u00a72\u00ba. Compete aos respons\u00e1veis previstos no artigos 26 e 27 da Resolu\u00e7\u00e3o TJES n\u00ba 07\/2016, a ado\u00e7\u00e3o das medidas necess\u00e1rias para o exato cumprimento da regra prevista no \u00a71\u00ba e, em nenhuma hip\u00f3tese, o est\u00e1gio poder\u00e1 ser realizado por per\u00edodo superior a 11 (onze) meses sem o correspondente gozo dos 30 (trinta) dias de recesso.<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">\u00a73\u00ba. Os dias de recesso remunerado podem ser concedidos de maneira fracionada, em dois per\u00edodos de 15 (quinze) dias, mediante acordo com o supervisor e comunica\u00e7\u00e3o pr\u00e9via.<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">\u00a74\u00ba. Os dias de recesso previstos neste artigo ser\u00e3o concedidos de maneira proporcional, nos casos de o est\u00e1gio ter dura\u00e7\u00e3o inferior a 01 (um) ano, conforme tabela\u00a0anexo I.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">Art. 2\u00ba. O aux\u00edlio-transporte e o aux\u00edlio-alimenta\u00e7\u00e3o n\u00e3o s\u00e3o devidos no per\u00edodo de descanso remunerado.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">Art. 3\u00ba. Os termos de compromisso de est\u00e1gio com dura\u00e7\u00e3o de 24 (vinte e quatro) meses dever\u00e3o fazer constar o gozo dos primeiros 30 (trinta) dias de recesso remunerado no 12\u00ba (d\u00e9cimo segundo) m\u00eas de est\u00e1gio e dos \u00faltimos 30 (trinta) dias no 24\u00ba (vig\u00e9simo quarto) m\u00eas.<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">\u00a71\u00ba. Os termos de compromisso de est\u00e1gio com dura\u00e7\u00e3o de 12 (doze) meses dever\u00e3o fazer constar o gozo dos 30 (trinta) dias de recesso remunerado no 12\u00ba (d\u00e9cimo segundo) m\u00eas de est\u00e1gio.<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">\u00a72\u00ba. Os termos de compromisso de est\u00e1gio com dura\u00e7\u00e3o menor que 12 (doze) meses dever\u00e3o fazer constar o gozo do recesso remunerado no \u00faltimo m\u00eas de est\u00e1gio, calculado proporcionalmente na forma do anexo I.<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">\u00a73\u00ba. Os termos de compromisso de est\u00e1gio com dura\u00e7\u00e3o maior que 12 (doze) meses e menor que 24 (vinte e quatro) meses dever\u00e3o fazer constar o gozo dos primeiros 30 (trinta) dias de recesso remunerado no 12\u00ba (d\u00e9cimo segundo) m\u00eas de est\u00e1gio e dos demais dias no \u00faltimo m\u00eas de est\u00e1gio, calculado proporcionalmente na forma do anexo I.<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">\u00a74\u00ba. Em todos os casos descritos anteriormente (caput e \u00a7\u00a7 1\u00ba ao 3\u00ba), quando da contrata\u00e7\u00e3o, a Se\u00e7\u00e3o de Sele\u00e7\u00e3o e Acompanhamento de Est\u00e1gio lan\u00e7ar\u00e1 em sistema o recesso remunerado conforme disciplinado neste Ato Normativo, com a suspens\u00e3o autom\u00e1tica do pagamento do aux\u00edlio-transporte (e alimenta\u00e7\u00e3o, no caso do estagi\u00e1rio conciliador) nos meses de frui\u00e7\u00e3o do benef\u00edcio.<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">\u00a75\u00ba. Na hip\u00f3tese de altera\u00e7\u00e3o dos meses de gozo do recesso remunerado, ou em caso de fracionamento do recesso em dois per\u00edodos de 15 (quinze) dias, a chefia imediata do estagi\u00e1rio dever\u00e1 solicitar a modifica\u00e7\u00e3o \u00e0 Se\u00e7\u00e3o de Sele\u00e7\u00e3o e Acompanhamento de Est\u00e1gio no processo SEI de contrata\u00e7\u00e3o do estagi\u00e1rio com pelo menos 30 (trinta) dias de anteced\u00eancia, para devidas altera\u00e7\u00f5es em sistema.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">Art. 4\u00ba. O recesso n\u00e3o poder\u00e1 ser usufru\u00eddo no feriado forense do per\u00edodo de 20 de dezembro a 6 de janeiro (art. 141, al\u00ednea \u201ce\u201d da LCE n\u00ba 234\/2002).<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">Art. 5\u00ba. N\u00e3o haver\u00e1 indeniza\u00e7\u00e3o referente ao recesso n\u00e3o usufru\u00eddo, salvo quando houver encerramento antecipado do termo de compromisso de est\u00e1gio, devendo os respons\u00e1veis pela fiscaliza\u00e7\u00e3o do est\u00e1gio garantirem o afastamento do acad\u00eamico no per\u00edodo de vig\u00eancia do programa, na forma estabelecida neste Ato Normativo.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">Art. 6\u00ba. A n\u00e3o observ\u00e2ncia do disposto neste Ato Normativo poder\u00e1 configurar infra\u00e7\u00e3o administrativa, sujeitando os respons\u00e1veis \u00e0s comina\u00e7\u00f5es previstas na legisla\u00e7\u00e3o, sem preju\u00edzo do ressarcimento ao er\u00e1rio.<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">Par\u00e1grafo \u00fanico. A Se\u00e7\u00e3o de Sele\u00e7\u00e3o e Acompanhamento de Est\u00e1gio dever\u00e1 comunicar os casos de descumprimento das regras deste regulamento \u00e0 Secretaria de Gest\u00e3o de Pessoas, a qual, concordando com as informa\u00e7\u00f5es prestadas acerca do descumprimento, as encaminhar\u00e1 ao Excelent\u00edssimo Desembargador Presidente, que decidir\u00e1 acerca do encaminhamento ao Excelent\u00edssimo Desembargador Corregedor-Geral da Justi\u00e7a ou, em se tratando de servidores do Tribunal de Justi\u00e7a, ao Secret\u00e1rio Geral, para provid\u00eancias cab\u00edveis.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">Art. 7\u00ba. Este Ato Normativo entra em vigor na data de sua publica\u00e7\u00e3o.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">Art. 8\u00ba. Revoga-se o <a href=\"https:\/\/www.tjes.jus.br\/corregedoria\/2022\/03\/21\/ato-normativo-no-024-2022-disp-21-03-2022\/\">Ato Normativo n\u00ba 024\/2022<\/a>.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p align=\"center\"><strong>ANEXO I<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p align=\"center\"><strong>TABELA COM REGRA DE C\u00c1LCULO
