{"id":3578,"date":"2016-07-05T12:38:16","date_gmt":"2016-07-05T15:38:16","guid":{"rendered":"https:\/\/www.tjes.jus.br\/corregedoria\/?p=3578"},"modified":"2017-03-02T15:23:57","modified_gmt":"2017-03-02T18:23:57","slug":"resolucao-no-232014-disp-15042014","status":"publish","type":"post","link":"https:\/\/www.tjes.jus.br\/corregedoria\/2016\/07\/05\/resolucao-no-232014-disp-15042014\/","title":{"rendered":"RESOLU\u00c7\u00c3O N\u00ba 23\/2014 &#8211; DISP. 15\/04\/2014"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>ESTADO DO ESP\u00cdRITO SANTO<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>PODER JUDICI\u00c1RIO<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>TRIBUNAL DE JUSTI\u00c7A<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>RESOLU\u00c7\u00c3O N\u00ba 23\/2014<\/strong><\/p>\n<p style=\"text-align: justify;\"><em>Disp\u00f5e sobre a realiza\u00e7\u00e3o de vistorias, pela Secretaria de Controle Interno, visando \u00e0 an\u00e1lise das medi\u00e7\u00f5es das obras de engenharia (constru\u00e7\u00e3o e reforma) contratadas pelo Poder Judici\u00e1rio do Estado do Esp\u00edrito Santo.<\/em><\/p>\n<p style=\"text-align: justify;\">O <strong>PRESIDENTE DO TRIBUNAL DE JUSTI\u00c7A DO ESTADO DO ESP\u00cdRITO SANTO<\/strong>, no uso das atribui\u00e7\u00f5es legais e regimentais, tendo em vista decis\u00e3o do egr\u00e9gio Tribunal Pleno, em sess\u00e3o realizada nesta data, e,<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> os princ\u00edpios constitucionais que regem a Administra\u00e7\u00e3o P\u00fablica e;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> a legisla\u00e7\u00e3o vigente e as determina\u00e7\u00f5es do Conselho Nacional de Justi\u00e7a referente ao controle efetivo das obras de engenharia (constru\u00e7\u00e3o e reforma) realizadas \u00e0 luz da Resolu\u00e7\u00e3o do Conselho Nacional de Justi\u00e7a (CNJ) n\u00ba 114\/2010;<\/p>\n<p style=\"text-align: justify;\"><strong>RESOLVE<\/strong>:<\/p>\n<p style=\"text-align: justify;\"><strong>Art. 1\u00ba <\/strong>Determinar, com base no valor total da contrata\u00e7\u00e3o, a realiza\u00e7\u00e3o, pela Secretaria de Controle Interno, de vistoria nas obras de engenharia contratadas pelo Tribunal de Justi\u00e7a (constru\u00e7\u00e3o e reforma):<\/p>\n<ul style=\"text-align: justify;\">\n<li>At\u00e9 R$150.000,00 (cento e cinquenta mil reais): n\u00e3o ser\u00e3o vistoriadas;<\/li>\n<li>Acima de R$150.000,00 (cento e cinquenta mil reais) at\u00e9 R$1.500.000,00 (hum milh\u00e3o e quinhentos mil reais): ser\u00e3o vistoriadas, no m\u00ednimo, 01 (uma) vez durante a vig\u00eancia do contrato;<\/li>\n<li>Acima de R$ 1.500.000,00 (hum milh\u00e3o e quinhentos mil reais): ser\u00e3o vistoriadas, no m\u00ednimo, 02 (duas) vezes durante a vig\u00eancia do contrato.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>Par\u00e1grafo \u00fanico.<\/strong> O quantitativo de vistorias previsto no <em>caput<\/em> poder\u00e1 ser acrescido:<\/p>\n<ul style=\"text-align: justify;\">\n<li>por determina\u00e7\u00e3o da Alta Administra\u00e7\u00e3o;<\/li>\n<li>nos casos em que a unidade de controle interno entender necess\u00e1rio.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>Art. 2\u00ba<\/strong> A Secretaria de Controle Interno informar\u00e1 \u00e0 Secretaria de Engenharia, Gest\u00e3o Predial e Manuten\u00e7\u00e3o de Equipamentos a data em que a vistoria ser\u00e1 realizada, com anteced\u00eancia m\u00ednima de 05 (cinco) dias.<\/p>\n<p style=\"text-align: justify;\"><strong>Par\u00e1grafo \u00fanico<\/strong>.
