{"id":47318,"date":"2026-05-20T13:53:48","date_gmt":"2026-05-20T16:53:48","guid":{"rendered":"https:\/\/www.tjes.jus.br\/corregedoria\/?p=47318"},"modified":"2026-05-20T13:54:36","modified_gmt":"2026-05-20T16:54:36","slug":"provimento-no-16-2026-disp-20-05-2026","status":"publish","type":"post","link":"https:\/\/www.tjes.jus.br\/corregedoria\/2026\/05\/20\/provimento-no-16-2026-disp-20-05-2026\/","title":{"rendered":"PROVIMENTO N\u00ba 16\/2026 \u2013 DISP. 20\/05\/2026"},"content":{"rendered":"\n<p class=\"Tabela_Texto_Centralizado\" style=\"text-align: center;\"><strong>PODER JUDICI\u00c1RIO DO ESTADO DO ESP\u00cdRITO SANTO &#8211; PJES<\/strong><\/p>\n<p class=\"Tabela_Texto_Centralizado\" style=\"text-align: center;\"><strong>CORREGEDORIA GERAL DA\u00a0JUSTI\u00c7A<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p class=\"Texto_Centralizado\" style=\"text-align: center;\"><strong>PROVIMENTO N\u00ba 016\/2026<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p class=\"Texto_Justificado\" style=\"text-align: justify;\" data-end=\"149\" data-start=\"0\">O Desembargador\u00a0<strong>Ewerton Schwab Pinto J\u00fanior<\/strong>, Corregedor Geral da Justi\u00e7a do Estado do Esp\u00edrito Santo, no uso de suas atribui\u00e7\u00f5es legais, e,<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p class=\"Texto_Justificado\" style=\"text-align: justify;\" data-end=\"376\" data-start=\"151\"><strong>CONSIDERANDO\u00a0<\/strong>que a Corregedoria Geral da Justi\u00e7a do Estado do Esp\u00edrito Santo \u00e9 \u00f3rg\u00e3o de fiscaliza\u00e7\u00e3o que disciplina a orienta\u00e7\u00e3o administrativa em todo o Estado, nos termos do art. 35 da Lei Complementar Estadual n\u00ba 234\/2002;<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p class=\"Texto_Justificado\" style=\"text-align: justify;\" data-end=\"675\" data-start=\"378\"><strong>CONSIDERANDO<\/strong>\u00a0que o C\u00f3digo de Normas \u00e9 a principal ferramenta de que disp\u00f5e a Corregedoria Geral da Justi\u00e7a para uniformizar a orienta\u00e7\u00e3o administrativa do foro judicial e extrajudicial em todo o Estado, sendo imperioso e necess\u00e1rio o constante aprimoramento das diversas disposi\u00e7\u00f5es nele contidas;<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p class=\"Texto_Justificado\" style=\"text-align: justify;\" data-end=\"837\" data-start=\"677\"><strong>CONSIDERANDO<\/strong>\u00a0a revoga\u00e7\u00e3o do art. 393 do C\u00f3digo de Processo Penal pela Lei n\u00ba 12.403\/2011, retirando o fundamento legal do registro denominado \u201crol de culpados\u201d.<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p class=\"Texto_Justificado\" style=\"text-align: justify;\" data-end=\"1181\" data-start=\"1173\"><strong>RESOLVE:<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p class=\"Texto_Justificado\" style=\"text-align: justify;\" data-end=\"1333\" data-start=\"1183\"><strong data-end=\"1195\" data-start=\"1183\">Art. 1\u00ba.<\/strong>\u00a0Revogar a al\u00ednea \u201ca\u201d, do inciso II, do art. 460 do Tomo I do C\u00f3digo de Normas da Corregedoria Geral da Justi\u00e7a do Estado do Esp\u00edrito Santo.<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p class=\"Texto_Justificado\" style=\"text-align: justify;\" data-end=\"1484\" data-start=\"1335\"><strong data-end=\"1347\" data-start=\"1335\">Art. 2\u00ba.<\/strong>\u00a0Este Provimento entra em vigor na data de sua publica\u00e7\u00e3o, revogando-se as disposi\u00e7\u00f5es em contr\u00e1rio.<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p class=\"Texto_Justificado\" style=\"text-align: justify;\" data-end=\"2133\" data-start=\"2097\">Publique-se.
