EM 18\/02\/2010"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>PODER JUDICI\u00c1RIO DO ESTADO DO ESP\u00cdRITO SANTO<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>TRIBUNAL DE JUSTI\u00c7A<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>CORREGEDORIA GERAL DA JUSTI\u00c7A<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>PROVIMENTO CGJES N\u00ba 005\/2010<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Suspende, por 30 (trinta) dias, a aprecia\u00e7\u00e3o das indica\u00e7\u00f5es de substitutos dos delegat\u00e1rios do servi\u00e7o notarial e de registro, formulados com base no art. 20, \u00a7 5\u00ba da Lei Federal n.\u00ba 8.935\/94 (Lei de Not\u00e1rios e Registradores), e d\u00e1 outras provid\u00eancias.<\/strong><\/p>\n<p style=\"text-align: justify;\">O Desembargador S\u00c9RGIO LUIZ TEIXEIRA GAMA, Corregedor-Geral da Justi\u00e7a, no uso de suas atribui\u00e7\u00f5es e,<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> que a Corregedoria Geral da Justi\u00e7a \u00e9 \u00f3rg\u00e3o de fiscaliza\u00e7\u00e3o, disciplina e orienta\u00e7\u00e3o administrativa das serventias do foro extrajudicial, com jurisdi\u00e7\u00e3o em todo o Estado, conforme art. 37 da Lei Federal n.\u00ba 8.935\/94, art. 2\u00ba da Lei Complementar Estadual n\u00ba 83\/96 e art. 35 da Lei Complementar Estadual n\u00ba 234\/02;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> a publica\u00e7\u00e3o no DJES de 14\/12\/2009 do ato da Corregedoria Geral da Justi\u00e7a de outorga da delega\u00e7\u00e3o dos servi\u00e7os extrajudiciais vagos aos candidatos aprovados no concurso p\u00fablico de provas e t\u00edtulos de ingresso na atividade notarial e de registro do Estado do Esp\u00edrito Santo (item 8.8 do Edital CGJES n.\u00ba 001\/2006);<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> a determina\u00e7\u00e3o contida no art. 20, \u00a7 5\u00ba da Lei Federal n.\u00ba 8.935\/94 (Lei de Not\u00e1rios e Registradores), para que &#8220;dentre os substitutos, um deles ser\u00e1 designado pelo not\u00e1rio ou oficial de registro para responder pelo respectivo servi\u00e7o nas aus\u00eancias e nos impedimento do titular&#8221;;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> a necessidade do Poder Judici\u00e1rio capixaba padronizar o procedimento administrativo a ser adotado quando da indica\u00e7\u00e3o feita pelo delegat\u00e1rio;<\/p>\n<p style=\"text-align: justify;\"><strong>RESOLVE:<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Art. 1\u00ba &#8211;<\/strong> Suspender, por 30 (trinta) dias, a aprecia\u00e7\u00e3o das indica\u00e7\u00f5es de substitutos dos delegat\u00e1rios do servi\u00e7o notarial e de registro, formulados com base no art. 20, \u00a75\u00ba da Lei Federal n.\u00ba 8.935\/94 (Lei de Not\u00e1rios e Registradores).<\/p>\n<p style=\"text-align: justify;\"><strong>Par\u00e1grafo \u00fanico.<\/strong> A determina\u00e7\u00e3o contida no caput ser\u00e1 observada pelos Ju\u00edzes Diretores de F\u00f3rum e\/ou das Varas dos Registros P\u00fablicos nas indica\u00e7\u00f5es pendentes de aprecia\u00e7\u00e3o.<\/p>\n<p style=\"text-align: justify;\"><strong>Publique-se.
