EM 27\/01\/2010"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>PODER JUDICI\u00c1RIO DO ESTADO DO ESP\u00cdRITO SANTO<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>TRIBUNAL DE JUSTI\u00c7A<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>CORREGEDORIA GERAL DA JUSTI\u00c7A<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>PROVIMENTO CGJ n\u00ba 002\/2010<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Suspender, provisoriamente, a exigibilidade do artigo 697 do C\u00f3digo de Normas da Corregedoria Geral da Justi\u00e7a.<\/strong><\/p>\n<p style=\"text-align: justify;\">O Desembargador S\u00c9RGIO LUIZ TEIXEIRA GAMA, Corregedor-Geral da Justi\u00e7a, no uso de suas atribui\u00e7\u00f5es e,<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> que a Corregedoria Geral da Justi\u00e7a \u00e9 \u00f3rg\u00e3o de fiscaliza\u00e7\u00e3o, disciplina e orienta\u00e7\u00e3o administrativa, com jurisdi\u00e7\u00e3o em todo o Estado, conforme art. 2\u00ba da Lei Complementar Estadual n\u00ba 83\/96 e art. 35 da Lei Complementar Estadual n\u00ba 234\/02;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> a recente publica\u00e7\u00e3o do novo C\u00f3digo de Normas, efetivado mediante o <a href=\"https:\/\/www.tjes.jus.br\/corregedoria\/index.php\/2016\/10\/11\/provimento-no-292009-disp-16122009\/\" target=\"_blank\">Provimento n.\u00ba 029\/2009<\/a>, publicado no DJ\/ES do dia 16.12.2009;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> solicita\u00e7\u00e3o formulada pela Ordem dos Advogados do Brasil- Seccional do Estado do Esp\u00edrito Santo;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> a disposi\u00e7\u00e3o contida no artigo 38 do C\u00f3digo de Processo Civil;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> o entendimento expendido pelo Superior Tribunal de Justi\u00e7a, no julgamento do Recurso Especial n.\u00ba 256.098\/SP, da relatoria do ministro S\u00c1LVIO DE FIGUEIREDO TEIXEIRA.<\/p>\n<p style=\"text-align: justify;\"><strong>RESOLVE:<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Art. 1\u00ba &#8211; SUSPENDER<\/strong> a exigibilidade do artigo 697 do C\u00f3digo de Normas da Corregedoria Geral da Justi\u00e7a.<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a7 1\u00ba<\/strong> &#8211; Orientar que se observe, na outorga de procura\u00e7\u00f5es para postular em ju\u00edzo, a disposi\u00e7\u00e3o contida no artigo 38 do C\u00f3digo de Processo Civil.<\/p>\n<p style=\"text-align: justify;\"><strong>Art. 2\u00ba &#8211;<\/strong> Este provimento entra em vigor na data da publica\u00e7\u00e3o.<\/p>\n<p style=\"text-align: justify;\"><strong>Publique-se.
