{"id":8159,"date":"2016-10-13T13:17:48","date_gmt":"2016-10-13T16:17:48","guid":{"rendered":"https:\/\/www.tjes.jus.br\/corregedoria\/?p=8159"},"modified":"2016-10-13T13:17:48","modified_gmt":"2016-10-13T16:17:48","slug":"provimento-no-212005-disp-18052005","status":"publish","type":"post","link":"https:\/\/www.tjes.jus.br\/corregedoria\/2016\/10\/13\/provimento-no-212005-disp-18052005\/","title":{"rendered":"PROVIMENTO N\u00ba 21\/2005 &#8211; DISP. 18\/05\/2005"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>ESTADO DO ESP\u00cdRITO SANTO<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>CORREGEDORIA GERAL DA JUSTI\u00c7A<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>PROVIMENTO N\u00ba 021\/2005<\/strong><\/p>\n<p style=\"text-align: justify;\">O EXCELENT\u00cdSSIMO SENHOR CORREGEDOR-GERAL DA JUSTI\u00c7A DO ESTADO DO ESP\u00cdRITO SANTO, DESEMBARGADOR FREDERICO GUILHERME PIMENTEL, NO USO DE SUAS ATRIBUI\u00c7\u00d5ES LEGAIS E,<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> que a Corregedoria Geral da Justi\u00e7a do Estado do Esp\u00edrito Santo \u00e9 \u00f3rg\u00e3o de fiscaliza\u00e7\u00e3o, disciplina e orienta\u00e7\u00e3o administrativa, com jurisdi\u00e7\u00e3o em todo o Estado, conforme artigo 2\u00ba da Lei Complementar Estadual 83\/96;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> a necessidade de buscar a padroniza\u00e7\u00e3o de procedimentos referentes a sindic\u00e2ncias e processos administrativos-disciplinares, estabelecendo de maneira clara compet\u00eancia e forma de atua\u00e7\u00e3o da comiss\u00e3o processante;<\/p>\n<p style=\"text-align: justify;\"><strong>R E S O L V E:<\/strong><\/p>\n<p style=\"text-align: justify;\">Artigo 1\u00ba &#8211; <strong>Alterar<\/strong> o C\u00f3digo de Normas da Corregedoria Geral da Justi\u00e7a do Estado do Esp\u00edrito Santo, que regula o exerc\u00edcio da fun\u00e7\u00e3o correicional e estabelece as normas de servi\u00e7o para o foro judicial e extrajudicial, em seu artigo 419, \u201ccaput\u201d, e \u00a7 1\u00ba , que passar\u00e3o a vigorar com a seguinte reda\u00e7\u00e3o:<\/p>\n<p style=\"text-align: justify; padding-left: 30px;\">\u201cArt. 419. O juiz de direito que tiver ci\u00eancia de irregularidade na serventia sob a sua responsabilidade, dever\u00e1 requisitar informa\u00e7\u00f5es pr\u00e9vias ao servidor envolvido, que as prestar\u00e1, por escrito, ao pr\u00f3prio ju\u00edzo, no prazo de cinco (05) dias, sob pena de configurar nova infra\u00e7\u00e3o, sem preju\u00edzo daquela que lhe \u00e9 imputada.<br \/>\n\u00a7 1\u00ba. Expirado o prazo, apresentadas ou n\u00e3o as informa\u00e7\u00f5es, o magistrado dever\u00e1 comunicar a irregularidade, imediatamente, \u00e0 Corregedoria Geral da Justi\u00e7a.<\/p>\n<p style=\"text-align: justify;\">Artigo 2\u00ba &#8211; Este provimento entra em vigor na data de sua publica\u00e7\u00e3o.<\/p>\n<p style=\"text-align: justify;\"><strong>REGISTRE-SE.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>PUBLIQUE-SE.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>CUMPRA-SE.<\/strong><\/p>\n<p style=\"text-align: justify;\">Vit\u00f3ria, 02 de maio de 2005.<\/p>\n<p style=\"text-align: center;\"><strong>DES.
