{"id":8161,"date":"2016-10-13T13:21:34","date_gmt":"2016-10-13T16:21:34","guid":{"rendered":"https:\/\/www.tjes.jus.br\/corregedoria\/?p=8161"},"modified":"2016-10-13T13:21:34","modified_gmt":"2016-10-13T16:21:34","slug":"provimento-no-222005-disp-13052005","status":"publish","type":"post","link":"https:\/\/www.tjes.jus.br\/corregedoria\/2016\/10\/13\/provimento-no-222005-disp-13052005\/","title":{"rendered":"PROVIMENTO N\u00ba 22\/2005 &#8211; DISP. 13\/05\/2005"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>ESTADO DO ESP\u00cdRITO SANTO<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>CORREGEDORIA GERAL DA JUSTI\u00c7A<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>PROVIMENTO N\u00ba 022\/05<\/strong><\/p>\n<p style=\"text-align: justify;\">O EXCELENT\u00cdSSIMO SENHOR CORREGEDOR-GERAL DA JUSTI\u00c7A DO ESTADO DO ESP\u00cdRITO SANTO, DESEMBARGADOR FREDERICO GUILHERME PIMENTEL, NO USO DE SUAS ATRIBUI\u00c7\u00d5ES LEGAIS E,<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> que a Corregedoria Geral da Justi\u00e7a do Estado do Esp\u00edrito Santo \u00e9 \u00f3rg\u00e3o de fiscaliza\u00e7\u00e3o, disciplina e orienta\u00e7\u00e3o administrativa, com jurisdi\u00e7\u00e3o em todo o Estado, conforme artigo 2\u00ba da Lei Complementar Estadual 83\/96;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> a publica\u00e7\u00e3o da Emenda Constitucional n\u00ba 45, de 31\/12\/2004, que determinou em seu artigo 93, XV, a distribui\u00e7\u00e3o imediata de processos em todos os graus de jurisdi\u00e7\u00e3o;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> o artigo 257 do C\u00f3digo de Processo Civil, no qual os feitos distribu\u00eddos e n\u00e3o preparados em 30 dias ser\u00e3o cancelados;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> que o artigo 17 da Lei 4.847\/93 disp\u00f5e sobre a obrigatoriedade do pagamento das despesas j\u00e1 exig\u00edveis quando da extin\u00e7\u00e3o do processo;<\/p>\n<p style=\"text-align: justify;\"><strong>CONSIDERANDO<\/strong> o conflito do Provimento n\u00ba 25\/89, do artigo 93 do C\u00f3digo de Normas e do artigo 15 da Lei 4.847\/93 com o novo texto constitucional, visto que as peti\u00e7\u00f5es iniciais sem preparo ficam aguardando pagamento nas contadorias sem a devida distribui\u00e7\u00e3o.<\/p>\n<p style=\"text-align: justify;\">R E S O L V E<\/p>\n<p style=\"text-align: justify;\">Art. 1\u00ba &#8211; Determinar que todas as peti\u00e7\u00f5es iniciais sejam cadastradas no setor de protocolo.<\/p>\n<p>\u00a71\u00ba &#8211; Ap\u00f3s o cadastramento, as peti\u00e7\u00f5es que forem pass\u00edveis de c\u00e1lculo de custas pr\u00e9vias ser\u00e3o encaminhadas \u00e0 contadoria.<\/p>\n<p>\u00a72\u00ba &#8211; As que n\u00e3o necessitarem de c\u00e1lculo de custas pr\u00e9vias ser\u00e3o encaminhadas diretamente ao Setor de Distribui\u00e7\u00e3o;<\/p>\n<p style=\"text-align: justify;\">Art. 2\u00ba &#8211; Nas Contadorias, as peti\u00e7\u00f5es iniciais, pass\u00edveis de cobran\u00e7a de custas, independente do pagamento imediato, ser\u00e3o encaminhadas ao setor de Distribui\u00e7\u00e3o acompanhadas do c\u00e1lculo das custas.<\/p>\n<p style=\"text-align: justify;\">Art. 3\u00ba &#8211; As peti\u00e7\u00f5es protocoladas a partir de 01\/01\/2005, que se encontram na contadoria aguardando preparo, dever\u00e3o ser imediatamente distribu\u00eddas.<\/p>\n<p style=\"text-align: justify;\">Art. 4\u00ba &#8211; Revogam-se o Provimento n\u00ba 25\/89 e o artigo 93 do C\u00f3digo de Normas no que for conflitante.<\/p>\n<p style=\"text-align: justify;\"><strong>REGISTRE-SE.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>PUBLIQUE-SE.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>CUMPRA-SE.<\/strong><\/p>\n<p style=\"text-align: justify;\">Vit\u00f3ria, 11 de maio de 2005.<\/p>\n<p style=\"text-align: center;\"><strong>DES.
